MARCH 2010, CURRENT ISSUE: MSP LIEN COMPLIANCE

As most already know, Mandatory Insurer Reporting (MIR) will allow the government to easily identify any unresolved conditional payments and the primary payers that are responsible for them. Under Section 111, the collection of information by COBC will be used to identify and recover past mistaken Medicare primary payments and to prevent Medicare from mistakes in the future for those Medicare Secondary Payer situations that continue to exist. In a time when insurers are being burdened with increases in conditional payments demands, it is clear that they need a competent partner.
As the implementation timeline nears for Liability insurance (including Self-Insurance), No-Fault Insurance and Workers’ Compensation, most primary payers are becoming more aware of their responsibilities in discovering conditional payments and seeking to negotiate the amounts with Medicare prior to settlement. As many cases settle without knowing what the conditional payments will be, this has given rise to a high increase in demand for conditional payments negotiation services.
At Royal-MSA Consultants, we can perform conditional payment investigations, negotiations, and appeals. Our expertise and exceptional experience results in considerable savings to our clients ensuring full MSP/SCHIP compliance.
With recent case law, it is clear that Medicare intends to collect and litigate. We will ensure that you are in full compliance with the MSP Statute.
It is also important to know that when submitting your query to COBC regarding a Medicare recipient, COBC will simply advise whether the claimant is a Medicare beneficiary or not. There will be no exchange of information. In many cases, the injured may have filed for benefits and may receive those benefits at a later time. In the event that the injured becomes eligible at a later time, this can cause significant problems in the settlement of the claim. We can secure this much needed information and provide you with accurate information so that a more informed decision is made when it comes time to settle.
